Patrick Jane is defiantly not red John because if you watch the behind the scenes part of the DVD for either season 1 or season 2 of the mentalist (I can't remember) there is an interview with Bruno Heller saying that they're not going to turn around and say "hey Patrick Jane is actually red john". So it can't be Patrick.
