Red John is not Kirkland's brother. Some people are saying that the hand shake between Bob Kirkland and PJ was actually with Michael Kirkland (Lorelei has already said that PJ and RJ have shaken hands).
If that was true then the first time PJ met Bob Kirkland, they would have shaken hands again or at least Bob Kirkland would have introduced himself again but all other times they meet each other its like they already know eachother.
(Same idea also applies for Theresa since Bob has met her many times aswell).
Okay...not really Bob Kirkland he is obviously dead, but I'm listing this under Bob because Red John is...
Bob's twin brother.
There was the random story by Bob last week about his twin brother who started getting involved in a cult and disappeared. No body found. That's because Bob's twin became the cult leader, Red John.
I just found it strange that Bob's brother was a) a twin, and b) body never found.
Technically, Jane could have met Bob's brother in the past (that was the one RJ clue he had to go on, that he "shook hands" with him in the past) if Bob's brother was impersonating Bob at some point.
There needs to be a surprise, more than just slowly whittling the list down to one. And if they throw out EVERYONE on the list and it's someone not on the list, well it's cheating and would be horribly unsatisfying. So...someone who is on the list (even though Jane doesn't realize it yet) and fits the bill of a surprise villain and a good Red John (really, the only two good RJs left are Malcom McDowell and the Sheriff...Bob was good but dead, Brett was good and creepy but dead...FBI guy boring, Reed Diamond and Bertram are cool but not really RJ brilliant.)

The tattoo is not actually a tattoo its a scar. a scar from a tiger, and the secret organisation know this hence 'Tyger Tyger' and Jane was a carnie/circus man, and circuses have tigers. Anyone who knows about the 'Tyger Tyger' is a member of undercover agent from the 'secret' organisation
red john is a mastermind... and his followers will do whatever he says en will follow him to the death...
with that in mind.. i dont think its ray.
i find ray a bit goofy... the way he walks and talks, and he makes alot of mistakes, first jane outsmarted him when he took over the team in season 3 but also in the latest episode ray was way off on the death of the guy in the hotel and became a suspect himself.
besides that, u remember that when he went over the details with lisbon and the team he was really demeaning against them when they didnt found anything usefull. he ended with 'cioau kids'.
for some reason i dont see lorelei and the others following him of falling in love with him, for me he doesnt smart/charismatic enough to be red john...
and besides that, for some reason if most people after seeing this episodes think its ray.. they are just falling for the red herrings of the writers, i dont think bruno heller was preparing 5 seasons of the mentalist just so people guesses who red john was since episode 2 of this season.. just doesnt seem right
