There is strong evidence that the revealed list was a fake planted by Jane. Jane was excluding people based on clues revealed in Season 5.
The knowledge that RJ was a kid when the smiley was painted on the barn would exclude Stiles from the list because he is far too old.
Kirkland shook hands with Jane after Lorelei was in prison and there is no way that RJ would sneak a message into Lorelei just to tell her that he's finally met and shaken hands with Jane.
According to Jane's criteria, neither of these would've made it on to Jane's list so the list must have been a fake.
It only makes sense because season five spent a great amount of time building up Kirkland as a character so he could steal Jane's list. Regardless of whether the list is real or fake, it would be statistically impossible for RJ to guess Jane's exact names plus the number seven for suspects without stealing it from Jane. Yes RJ might have spent hours listing people Jane might have met and narrowed it down himself but it impossible that he would narrowed it down to the exact same number and names. It would be complicated to have Lorelei make the video before Kirkland stole the list but not impossible if RJ had also stolen Jane's longer list of suspect and edited Lorelei afterward.
The show delibrately show Jane setting a trap with the toothpick and smiling when he realizes that someone broke in to his loft. The only reason for that smile would be if Jane had planted the list.
Heller said that RJ is definitely on Jane's list but we never heard all of Jane's list. Jane only said Bertram and he never confirmed that RJ's list was his own. You'd think that if the list was real, Lisbon would looked to Jane to see confirmation that RJ had guess right. That the episode doesn't include that confirmation and mutual questioning of RJ's methods, means that the writers did not want to absolutely confirm the list.
Everyone has been disappointed by the list judging by the comments. I can't believe that the writers would be stupid enough to choose flat characters as suspects when they've spent so much time building up really good suspects like Mashburn, Winter, Harken, etc. This is just a very clever mislead. Heller didn't lie when he said RJ was on Jane's list but we haven't heard Jane's list yet - only RJ's prediction which was likely planted by Jane. Heller didn't lie when he said names would be named either. We heard names but we don't know if they were the correct names. This is like the Season three final where it seemed obvious that RJ was dead.
