Red john is on the list of seven. Jane's list is within the list of seven. But he's closer than he's told anyone. He's allowed Red John to see that he's close "the toothpick trick" but he's concealed how close he truly is from Red John...from everyone. He's done this in order to place himself one step ahead of red john. He needs red john to know that he's close so that he will panic and make a mistake. Not letting him see the extent of how close he really is not only puts Jane essentially one step ahead, but also will serve to humiliate red john in the end. My guess? Its Bertram. After the premiere I feel that Bertram is even more errogant and vindictive than I felt before. I think that he's not only capable of committing these crimes but the way he talks is identical to the way red john talks. The only difference is in the pitch. Pay attention to his diction and his tone. I think that the falsetto is his real voice and he covers it with his Bertram voice in everyday life. I'm guessing that Jane is strongly suspicious of Bertram and uses a larger lslist to throw him off. That's my theory
