I still think it is Bob Kirkland.  The one who was shot was NOT Bob Kirkland, it was his twin brother pretending to be Kirkland.  The twin knew his brother was Red John and was trying to stop him.   Bertram, Smith, and McAlister are disciples, which is why Smith killed the twin who was trying to expose Red John.
